Introduction

These Terms and Conditions ("Terms") govern your use of the Cubuc mobile application ("Application") and the services provided by Cubuc ("we," "us," or "our"). By accessing or using the Application, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Application.

Use of the Application

• Eligibility: You must be at least 18 years old to use the Application.
• Account Registration: You may need to create an account to access certain features of the Application. You agree to provide accurate and complete information during the registration process and to keep this information up to date.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Services

Cubuc provides various services including online coolie booking, wheelchair assistance, and luggage transportation with coolies and trolleys. The specific terms and conditions for each service will be provided within the Application.

Payments

• Payment Processing: All payments are processed through secure third-party payment gateways. By using our services, you agree to the terms and conditions of the respective payment gateway.
• No Refund Policy: Once a service is booked and payment is made, no refunds will be provided under any circumstances.

User Conduct

You agree not to use the Application for any unlawful or prohibited activities, including but not limited to:

• Engaging in any activity that interferes with or disrupts the Application or its servers.
• Impersonating any person or entity or misrepresenting your affiliation with any person or entity.
• Collecting or storing personal data about other users without their consent.

Intellectual Property

All content, features, and functionality of the Application, including but not limited to text, graphics, logos, and software, are the exclusive property of Cubuc and are protected by copyright, trademark, and other intellectual property laws.

Limitation of Liability

To the maximum extent permitted by law, Cubuc shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Application.
• Any conduct or content of any third party on the Application.
• Any content obtained from the Application.
• Unauthorized access, use, or alteration of your transmissions or content.

Indemnification

You agree to indemnify and hold harmless Cubuc and its affiliates, officers, agents, employees, and partners from and against any claims, liabilities, damages, losses, and expenses, including but not limited to reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Application or your violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, India.

We may update these Terms from time to time for any reason. We will notify you of any changes by posting the new Terms here and informing you via email or text message. You are advised to consult these Terms regularly for any changes, as continued use is deemed approval of all changes.
